Weekend demolition work at Candlestick Staduim without dust inspectors

Demolition work being done on weekend without notice to community and Dust inspectors. On August, 10, 2015, there was demolition work going on at Candlestick Stadium. The heavy equipment operators were dismantleing a concrete wall without watering to calm the dust. I called the BaMMQmd and lodged a complaint. I received a call the following Monday from Mr Vick Rodriquez, Upo speaking to Mr, Rodriquez, I realized that he did not have the basic knowledge on handling complaints at this site or how to mitigate them. I asked him if the company had filed a weekend work schedule, he said that they were notified late Friday afternoon. I told him that was unexceptable. and that they had to do a be, bytter job as inspectors holding Lennar Developers accountable for their actions and fine them for repeated violations of the dust plan.

Based on testimony provided at the last BVHP Environmental Justice Coalition meeting, I referred the weekend demolition dust control complaint to Dept. of Building Inspection - Building Inspection Division (DBI). Lennar's rep confirmed that weekend demolition of a dugout at Candlestick occurred on Saturday, August 8th. As a result of my referral, DBI issued a notice of correction to the Lennar contractor permitted to do demolition work at the Candlestick site, Silverado Construction, because 1) there was no third party inspector present as required by the site's Dust Control Plan, who should be onsite to verify dust control practices, and 2) there also needed to be evidence provided that both particulate and asbestos air monitoring that occurred on that date, as required by the site's Dust Control Plan for all work days. An independent third party inspector would have been able to resolve the discrepancy between Silverado Construction stating that they were using wetting practices during the demolition and the neighbor observing a lack of wetting practices. The asbestos and particulate monitoring occurring on that date were both verified, without any data points of concern for asbestos or particulate levels at the four site perimeter locations. However, one particulate monitoring location had been compromised on that date due to equipment failure. Again, a third party inspector would have been able to identify the equipment failure, and work would have been stopped until monitoring capability was corrected, in accordance with the Dust Control Plan. DBI's corrective action with the demolition contractor is still in progress.

To clarify, asbestos monitoring was in place during this operation and that data was reported in a timely manner to regulatory agencies. Even though the Air District inspector could not arrive at the site on the day of, an investigation did take place. The inspector found that asbestos monitors were operating that day and found no violations of the Asbestos Dust Mitigation Plan. The City's Building Inspection Division enforces the Dust Control Plan, and issued a correction notice based on their investigation. The Air District tries to send an inspector to the Candlestick site each time there is weekend work, but this is not always possible. Inspectors are also on call on weekends in case there are several complaints are lodged through our complaint line and we need someone to respond on that day.
